Privacy and personal data protection policy, cookie management on the www.baumard.fr website - November 2021 

It is only natural that you should attach particular importance to the way your data is obtained, used and shared.

This personal data protection policy (hereinafter the "Policy") has been drawn up to inform you of the practices and conditions under which Domaine des Baumard (hereinafter "Domaine des Baumard" or the "Company") collects, uses and stores your personal data (hereinafter the "Data").

If any provision of this Policy is found to be invalid or unlawful, it shall be deemed to be unwritten but shall not invalidate the remaining provisions of this Policy.

This Policy applies to Data collected through the collection forms for :

  • Create a user account to order our products and request quotes,
  • Contact us,
  • Reporting illegal content,
  • Subscribe to Newsletters

It does not apply to information collected by any third parties or through sites operated by them; including through applications or content (including advertisements) that redirect the user to the Site.

Please read the Policy carefully so that you clearly understand our practices regarding the treatment of your Data and inform you that consultation and/or use of our Sites necessarily entails acceptance of this Policy.

If you do not agree to the latter, please do not use our Sites.

It is your responsibility to ensure that the Data communicated to the Domaine des Baumard is complete and up to date.

 

1. What data is collected by the Domaine des Baumard?

Depending on the nature and purpose of your interaction with the Domaine des Baumard (creation of a user account, subscription to one or more newsletters, completion of contact forms, as well as any telephone exchanges) we may collect the following Data:

Your e-mail address will be requested on all our collection forms and more specifically, if you wish to :

  • Create a user account,
  • Contact us
  • Reporting illegal content,
  • Subscribe to our Newsletters.

You may be asked to provide personal information such as your name, first name, e-mail address and telephone number;

Browsing data: this is data relating to the way in which you use the Sites, including: IP address, browser used, browsing time, search history, operating system used, language and pages viewed;

Data about your visits to our Sites, including traffic data, log files and other data or communication resources you use when accessing our Sites;

Data relating to the use of social networks when you use their features.                                                                                       

2. How is your data collected?

Data may be collected in different ways on the Sites.

It may be collected directly when you communicate them to us by means of the forms for creating a user account, subscribing to the Newsletters available on the Sites, or reporting illicit content.  

In addition, we may collect your Data when you use the various contact forms on the Site and/or when you communicate with Domaine des Baumard by telephone or e-mail.

When you contact us by these different means, a copy of your exchanges with the Domaine des Baumard, including e-mail addresses, is made and archived.

You may also submit information to us for publication ("Submissions") on our open access Sites, or for transmission to other users or third parties.

Your Contributions posted on the Sites are published at your own risk.

Domaine des Baumard cannot control the actions of other users of the Sites with whom you share your Contributions.

Thus, we cannot guarantee that your Contributions will not be viewed by unauthorised users.

Requests for the removal of Contributions published on the Sites should be sent to contact@baumard.fr.

In some cases, Contributions may not be deleted.

If so, you will be informed of the reason for the refusal.

Domaine des Baumard also collects your Data indirectly by means of cookies/trackers.

3. Why is your data collected?

We collect and use your Data for :

  • To introduce you to our Sites and their contents,
  • To enable you to benefit from our services,
  • Allow us to contact you,
  • To offer you our newsletters, products and services that you may wish to use,
  • Notify you of changes to our Sites or to our product and service offerings,
  • To comply with our rights and obligations under contracts with users and for any other legal purposes.

We also use cookies or trackers:

In order to improve your user experience, in particular by :

  • allowing the Sites to recognise your hardware, so you won't have to provide the same information over and over again to perform the same task;
  • recognising the username and password you have already provided so that you do not have to enter them on every web page that requests them.

Analyze traffic and data on the Sites in order to :

  • help us understand how you use our Sites so that we can improve them.

4. Who processes your data?

Your Data are processed by the Domaine des Baumard employees in charge ofmanaging the Sites;

Furthermore, in the context of our activity, and for external processing purposes, your Data may be communicated to subcontractors, service providers or other third parties, and in particular for the management of our email campaigns (Newsletters).

The latter are bound by contractual obligations to respect the confidentiality of the Data and to use it only for the purposes for which we provide it.

Finally, we may also disclose your Data:

  • to comply with any legal mandate, law or legal process, including government and regulatory requests;
  • if we believe that disclosure is necessary or appropriate to protect the rights, property or safety of Domaine des Baumard, its customers or other stakeholders. Such disclosure includes exchanging information with other companies and organisations for the purpose of protecting against fraud and counterfeiting.

Links to third party sites

The Site may contain links to various social networking platforms managed on third-party servers by persons or organisations over which Domaine des Baumard has no control.

As a result, we cannot be held responsible for how your Data is stored or used on the servers of these third parties.

We advise you to read the applicable data protection policy of each third party website you access through our Site to understand how your Data will be used.

5. How long will your data be kept?

The Domaine des Baumard only keeps your Data for the period necessary for the purposes set out in Article 3.

This retention period is not the same depending on the Data in question, the nature and purpose of the collection being likely to vary this period. Similarly, certain legal obligations impose a specific retention period.

When you contact the Domaine des Baumard using the various contact forms or telephone numbers, your Data will be kept for three (3) years from the last exchange with the Domaine des Baumard and then deleted.

Your User Account Information is retained for the duration of your registration and for two (2) years after you close your account.

When you wish to receive our Newsletters, or have signed up for our Sites' Newsletters, your Data will be kept until you unsubscribe from them. If you have not agreed to receive our Newsletters in this form, your Data will be kept for two (2) years.

When you report an illegal content to Domaine des Baumard, the duration of the retention of the Data will vary according to the infringement in question and the statute of limitations applicable to it.

Finally, with regard to the Data collected by means of cookies or tracers, they will be kept for up to six (6) months for cookies or tracers measuring the audience and up to thirteen (13) months for the others.

6. How is your data protected?

Your Data is stored on secure servers protected by firewalls and antivirus software.

We have implemented technical and organisational measures to ensure the security and confidentiality of your Data against accidental loss and against unauthorised access, use, modification and disclosure.

However, due to the inherent characteristics of the Internet, it is impossible to guarantee optimal security for the exchange of information on this network.

We strive to protect your Data, but we cannot guarantee the absolute security of the information transmitted to the Site. You agree that you transmit your Data at your own risk.

We cannot be held responsible for any breach of the privacy settings or security measures in place on our Sites.

In this regard, you agree that the security of your information is also your responsibility. For example, it is your responsibility to keep the password that allows you to access your user account secret.

Under no circumstances should you disclose it to third parties. Also, be careful when disclosing information in the public areas of the Site, as these areas can be viewed by any user of the Site.

7. What are your rights?

You can choose how the Data you provide to us is used:

You can browse the Site without providing any Data.

If this happens, you will not be able to use certain features of the Sites, including registering on the site.

You can decide not to receive the newsletter.

You can then unsubscribe using the link in the email that sends you the newsletter,

You can choose not to provide your email address in the various contact forms.

Please note that you will not be able to obtain a response from the Domaine des Baumard you wish to contact.

In any event, you may access your user accounts at any time to view or update your Data.

In accordance with the provisions of the applicable regulations on the protection of personal data, in particular the European Regulation 2016/679 on Data Protection (hereinafter the "RGPD") as well as the law of 6 January 1978 n°78-17 known as "Informatique et Libertés" and its amendments, you have a right of access and a right to rectify your Data.

You also have the right to define directives concerning the fate of your Data in the event of your death.

In addition, subject to the conditions laid down in the said regulations for the exercise of these rights, you are entitled to :

  • A right to the deletion of your Data;
  • A right to limit the processing of your Data;
  • A right to object to the processing of your Data on legitimate grounds, in accordance with Article 21 of the GDPR;
  • A right to portability of the Data you have provided;
  • The right to withdraw consent, where consent has been requested.

Where the processing of your Data is carried out on the basis of your consent, you may withdraw it at any time. You acknowledge, however, that the processing carried out prior to the revocation of your consent remains perfectly valid.

You also have the right to object, without giving any reason, to Domaine des Baumard profiling your Data in the context of sending content or communications for commercial prospecting purposes.

However, in accordance with Article 12.6 of the RGPD, in order to exercise these rights, Domaine des Baumard, as the data controller, reserves the right to ask you to prove your identity. We inform you that the data enabling you to prove your identity will be deleted once we have responded to your request.

You can exercise these rights by sending an email in French to contact@baumard.fr       

We have one month to respond to any request to exercise your rights. This period may be extended by two months, due to the complexity or excessive number of requests.

Finally, you have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), notably on its website www.cnil.fr.

8. Does Domaine des Baumard transfer your data outside the European Union?

No, the Data collected in the context of the use of the Sites are hosted by the company OVH France whose servers are located on the territory of the European Union.

By using the Sites, you therefore agree that your Data may be transferred to these servers.

9. Cookies

9.1 What is a cookie?

A cookie is a file saved on your computer when you browse a site. This file contains various information relating to your operating system, your browser and the terminal you are using (computer, mobile, tablet). It may also record your IP address and your various interactions with the content of the www.baumard.fr website and newsletters. If you accept cookies in your browser, we and our partners can process the above-mentioned navigation information. If you deactivate your cookies, you may not be able to use all the services of the Domaine des Baumard (e.g. your user name and password will no longer be saved, your current shopping baskets will no longer be saved...).

10. Data sharing

The Domaine des Baumard undertakes never to sell or rent your data or to give up access to it without your prior consent unless we are obliged to do so (legal obligation, fight against fraud, exercise of the rights of defence, etc.).

Access to our database is limited to Domaine des Baumard employees who are authorised by virtue of their position and who are committed to respecting our privacy policy.

Personal data (name/first name/address/email...) are only passed on to our transporters to ensure the delivery of the goods under good conditions and to our payment partners.

Other data (such as browsing history, products viewed, etc.) are shared anonymously with partners who are subject to the European General Regulation on the protection of personal data and the French Data Protection Act. These partners are also contractually bound to respect the confidentiality of your data.

11. Rectification and deletion of data
